1. Business identity

2. Scope of application

These Terms & Conditions apply to all offers, orders, purchases and services provided by Herbysteam, including the sale of products via the webshop, wellness consultations, pelvic steaming sessions, movement guidance, and any future services or products offered by Herbysteam. By placing an order or booking a service, the client explicitly accepts these Terms & Conditions.

3. Nature of services – no medical advice

All services, products and information provided by Herbysteam are intended solely for general wellbeing purposes. They do not constitute medical advice, diagnosis or treatment, nor are they a substitute for professional medical care. Clients remain fully responsible for their health decisions and are advised to consult a qualified healthcare professional for medical concerns.

4. Products

Herbal blends sold by Herbysteam are intended exclusively for external use through steaming and are not ingested. Accessories such as steam stools, pots, textiles, bags, blankets and hot water bottles are intended for personal wellness use only. Product descriptions are provided in good faith; minor variations do not constitute non-conformity.

5. Orders and contract formation

A contract is formed once an order has been placed and payment has been successfully completed via the webshop. Herbysteam reserves the right to refuse or cancel orders in case of pricing errors, technical issues, incorrect information, or suspected fraud or abuse.

6. Prices and payment

All prices are stated in euros and include VAT unless explicitly stated otherwise. Payments are processed via bank transfer, credit card, Stripe or PayPal. Invoices are issued automatically via the webshop platform.

7. Delivery and transfer of risk

Delivery times are indicative and do not constitute a binding deadline. The risk of loss or damage to products transfers to the customer at the moment of delivery. Herbysteam is not responsible for delays caused by carriers or force majeure.

8. Right of withdrawal and returns

In accordance with EU consumer law, customers may withdraw from the purchase of non-used accessories and steam chairs within 14 days of receipt. Herbal blends are excluded from the right of withdrawal for hygiene and safety reasons. Returned products must be unused, undamaged and in original packaging. Return shipping costs are borne by the customer unless otherwise agreed.

9. Services, appointments and execution

Consultations and sessions may take place online or in person. The services provided by Herbysteam constitute an obligation of means, not an obligation of result. No guarantees are given regarding outcomes or results. Clients are responsible for providing accurate information and a safe environment during sessions.

10. Cancellation and no-show policy

Appointments may be cancelled or rescheduled up to 24 hours prior to the scheduled time. Late cancellations or failure to attend an appointment may result in the full session fee being charged.

11. Client responsibility and proper use

Clients declare that all information provided is truthful and complete. Clients are solely responsible for the correct use of products, adherence to instructions, and any decisions made based on information provided by Herbysteam.

12. Liability

To the maximum extent permitted by Belgian and EU law, Herbysteam shall not be liable for indirect or consequential damages, loss of income, loss of opportunity, or damages resulting from improper use of products or failure to follow instructions. Nothing in these Terms limits liability in cases of intent, gross negligence, or mandatory consumer protection provisions.

13. Force majeure

Herbysteam shall not be held liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural events, illness, technical failures, strikes or governmental measures.

14. Intellectual property

All texts, materials, protocols, images and content provided by Herbysteam remain its exclusive intellectual property and may not be reproduced, distributed or used without prior written consent.

15. Electronic communication

Communication may take place via email or messaging applications such as WhatsApp or Signal. Electronic communication may not be fully secure; by using these channels, the client accepts this inherent risk.

16. Complaints and dispute resolution

Complaints must be submitted in writing to eva@herbysteam.com within a reasonable time. Consumers may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

17. Governing law and jurisdiction

These Terms & Conditions are governed by Belgian law. Any disputes shall fall under the exclusive jurisdiction of the competent Belgian courts, without prejudice to mandatory EU consumer protection rules.

18. Severability and amendments

If any provision of these Terms & Conditions is found invalid or unenforceable, the remaining provisions remain fully applicable. Herbysteam reserves the right to amend these Terms & Conditions at any time. The version published on the website at the time of the transaction shall apply.
